The Criminal Records Database is a national database containing information on persons and the punishments imposed on them. It is based on final court judgments and decisions by extrajudicial authorities. The information in the database is generally public, but in some cases access is restricted by exceptions provided for by law. More detailed rules on the data entered in the database, as well as the procedures and conditions for the disclosure of such data, can be found in the Criminal Records Database Act.
Queries about yourself or other persons can be made independently in the e-File information system.
Data may be retrieved from the e-File system under the following conditions:
- Queries concerning yourself, your minor child, or a legal person you represent are free of charge without restriction.
- If the aforementioned queries are made by another person on the basis of an authorisation granted via the e-File, the query is also free of charge.
- Queries made to check restrictions on working with children are always free of charge. See further information on the page Restrictions on working with children.
- Queries regarding another person’s data without authorisation from that person are subject to a fee (EUR 4.00), which is paid via the bank link in the e-File system when the query is made.
Important: When making queries about other persons, only current punishments are displayed. Archived punishment data is only issued on the grounds listed in § 20 of the Criminal Records Database Act.
If you are unable to use the e-File system but require a Criminal Records Database extract that is digitally signed or on paper, you may request an official document from the Criminal Records Database regarding information concerning your punishment or the absence thereof. All queries are logged and visible in the query history to both the person making the query and the person to whom the data relates.
NB! There must be a clear legal basis for the querying and further processing of personal data – e.g. the entry into or performance of a contract, a legitimate interest, or another basis arising from Article 6 of the General Data Protection Regulation.
